En ce qui concerne la conception sans obstacle, les nouveaux projets de construction, y compris la plupart des extensions aux b\u00e2timents, sont assujettis aux exigences de l\u2019article 3.8 du CBO, avec quelques exceptions fond\u00e9es sur la taille du b\u00e2timent propos\u00e9 et la classification selon l\u2019usage principal.<\/p><p>Lorsque des r\u00e9novations sont propos\u00e9es pour un b\u00e2timent existant, l\u2019application des exigences relatives \u00e0 la conception sans obstacle repose sur certaines conditions. L\u2019intention du CBO est de faire appliquer les dispositions relatives \u00e0 la conception sans obstacle \u00e0 toutes les r\u00e9novations.<\/p><p>Comme certains facteurs \u2014 tels que les marges de reculement d\u2019une propri\u00e9t\u00e9, l\u2019espace disponible dans le b\u00e2timent et la construction existante \u2014 peuvent limiter les travaux de r\u00e9novation d\u2019un b\u00e2timent pour satisfaire aux exigences compl\u00e8tes de l\u2019article\u00a03.8 sans d\u00e9penses excessives ou au moyen d\u2019installations suppl\u00e9mentaires, le CBO fournit des exigences pour am\u00e9liorer l\u2019accessibilit\u00e9 \u00e0 l\u2019int\u00e9rieur d\u2019un b\u00e2timent afin d\u2019aider les personnes \u00e0 mobilit\u00e9 r\u00e9duite ou ayant une d\u00e9ficience sensorielle.<\/p><p>L\u2019\u00e9tape suivante du processus consiste \u00e0 d\u00e9terminer la port\u00e9e des r\u00e9novations. Ce terme est souvent utilis\u00e9 de mani\u00e8re vague, dans l\u2019espoir que d\u2019autres exemptions seront accord\u00e9es en raison du fait que le b\u00e2timent existant a \u00e9t\u00e9 construit en vertu d\u2019un CBO moins rigoureux. L\u2019id\u00e9e sous-jacente n\u2019est pas fausse, car les exigences du CBO ne sont pas r\u00e9troactives. Cependant, d\u00e8s qu\u2019une modification est propos\u00e9e \u00e0 l\u2019\u00e9l\u00e9ment existant, la r\u00e8gle est de se conformer aux crit\u00e8res \u00e9tablis ant\u00e9rieurement. Il est important d\u2019\u00e9valuer les travaux de r\u00e9novation en tenant compte des \u00e9l\u00e9ments qui seront modifi\u00e9s pour limiter les surprises durant le processus de d\u00e9livrance de permis. Lorsque des \u00e9l\u00e9ments existants sont consid\u00e9r\u00e9s comme \u00ab\u00a0prot\u00e9g\u00e9s par des droits acquis\u00a0\u00bb, il est probable que ces \u00e9l\u00e9ments font partie des solutions de rechange pour la conformit\u00e9 \u00e9nonc\u00e9es \u00e0 l\u2019article\u00a011.5 qui auraient \u00e9t\u00e9 utilis\u00e9es parce que certaines exigences \u00e9taient impossibles \u00e0 satisfaire et soumises \u00e0 l\u2019approbation du directeur de la construction. Il se peut aussi que ces \u00e9l\u00e9ments existants ne fassent pas partie du projet de r\u00e9novation et donc, qu\u2019ils n\u2019aient pas \u00e9t\u00e9 soumis \u00e0 l\u2019application du CBO.<\/p><p>Notre soci\u00e9t\u00e9 effectue souvent des v\u00e9rifications de l\u2019accessibilit\u00e9 dans le but d\u2019aider ses clients \u00e0 dresser une liste des \u00e9l\u00e9ments sans obstacle qui devraient \u00eatre am\u00e9lior\u00e9s si des changements sont propos\u00e9s ou dans le cadre de la planification des immobilisations pour des am\u00e9liorations proactives. Gr\u00e2ce au rapport fourni, les \u00e9quipes charg\u00e9es de la planification des immobilisations peuvent \u00e9tablir l\u2019ordre de priorit\u00e9 des r\u00e9novations pour chaque b\u00e2timent, afin que les travaux puissent \u00eatre planifi\u00e9s de fa\u00e7on \u00e0 faciliter ou \u00e0 maintenir l\u2019accessibilit\u00e9.
